1. Purpose of the App
The App is intended to facilitate the collection, management, reporting, and documentation of asbestos-related inspections, in compliance with:
- The Colorado Department of Public Health and Environment (CDPHE) asbestos regulations under Regulation No. 8, Part B - Asbestos;
- The Federal Asbestos Hazard Emergency Response Act (AHERA) and National Emission Standards for Hazardous Air Pollutants (NESHAP) under 40 CFR Part 61;
- Any other applicable state, federal, or local regulations.
2. User Responsibilities
By using this App, you agree:
- To provide accurate and complete data;
- To use the App only for legal and regulatory-compliant purposes;
- Not to use the App to submit, store, or transmit any false, misleading, or unauthorized data;
- To ensure your use of the App is consistent with your licensure or certification under applicable asbestos inspection regulations;
- To notify Us immediately of any suspected data inaccuracies or security breaches.
3. Data Ownership and Confidentiality
- All data collected through the App belongs to Us, unless otherwise specified by contract.
- Users are prohibited from exporting or distributing data except as expressly authorized.
- Personal information and sensitive site data shall be handled in accordance with our privacy policy and applicable data protection laws.
4. Compliance with Law
You are solely responsible for ensuring your use of the App complies with:
- CDPHE asbestos rules (including notification, recordkeeping, and sampling requirements);
- Federal requirements under NESHAP and AHERA;
- OSHA standards for workplace asbestos exposure, where applicable.

The App is provided “as is” without warranty of any kind. We do not warrant that:
- The App will operate uninterrupted or error-free;
- The data collected will always meet regulatory documentation requirements.
6. Limitation of Liability
To the fullest extent permitted by law, We are not liable for any direct, indirect, incidental, or consequential damages arising from:
- Use or inability to use the App;
- Regulatory violations resulting from user error or incomplete data;
- Third-party misuse of access credentials.
7. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for violation of these Terms or any misuse that may jeopardize regulatory compliance or system integrity.
