Terms of Use – WorkFlowEffective Date: September 18, 2024 These Terms of Use ("Terms") govern your access to and use of the WorkFlow asbestos inspection application ("App"), provided by Advent Asbestos, LLC d/b/a Advent Asbestos Consulting, LLC ("Company," "we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms.

1. Purpose of the AppThe App is intended to facilitate the collection, management, reporting, and documentation of asbestos-related inspections, in compliance with:

• The Colorado Department of Public Health and Environment (CDPHE) asbestos regulations under Regulation No. 8, Part B - Asbestos;
• The Federal Asbestos Hazard Emergency Response Act (AHERA) and National Emission Standards for Hazardous Air Pollutants (NESHAP) under 40 CFR Part 61;
• Any other applicable state, federal, or local regulations.

Use of the App is limited to authorized personnel who are certified or trained to perform asbestos-related work, as required by law.

2. User ResponsibilitiesBy using this App, you agree:

• To provide accurate and complete data;
• To use the App only for legal and regulatory-compliant purposes;
• Not to use the App to submit, store, or transmit any false, misleading, or unauthorized data;
• To ensure your use of the App is consistent with your licensure or certification under applicable asbestos inspection regulations;
• To notify Us immediately of any suspected data inaccuracies or security breaches.

3. Data Ownership and Confidentiality

• All data collected through the App belongs to Us, unless otherwise specified by contract.
• Users are prohibited from exporting or distributing data except as expressly authorized.
• Personal information and sensitive site data shall be handled in accordance with our privacy policy and applicable data protection laws.

4. Compliance with LawYou are solely responsible for ensuring your use of the App complies with:

• CDPHE asbestos rules (including notification, recordkeeping, and sampling requirements);
• Federal requirements under NESHAP and AHERA;
• OSHA standards for workplace asbestos exposure, where applicable.

Violation of these laws may result in civil or criminal penalties and termination of your access to the App.

5. No WarrantyThe App is provided “as is” without warranty of any kind. We do not warrant that:

• The App will operate uninterrupted or error-free;
• The data collected will always meet regulatory documentation requirements.

It is your responsibility to verify and submit required notifications or documentation to regulatory agencies.

6. Limitation of LiabilityTo the fullest extent permitted by law, We are not liable for any direct, indirect, incidental, or consequential damages arising from:

• Use or inability to use the App;
• Regulatory violations resulting from user error or incomplete data;
• Third-party misuse of access credentials.

7. TerminationWe reserve the right to suspend or terminate your access to the App at any time, with or without notice, for violation of these Terms or any misuse that may jeopardize regulatory compliance or system integrity.

8. AmendmentsWe may update these Terms at any time. Continued use of the App after changes are made constitutes your agreement to the revised Terms.

9. Governing LawThese Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Jefferson County, Colorado.
