Premium Prep – Terms and Conditions

1. Purpose and Scope of Service
Premium Prep is a limited-use service offered by Advent Asbestos Consulting, LLC (“Company”) to provide property owners with a cost-effective option for submitting building material samples to accredited laboratories. The purpose of this service is to obtain preliminary information regarding the potential presence of asbestos in sampled materials. Such information is useful in aiding the Company with determining the most economical approach to providing a certified asbestos inspection by ruling out materials that can easily be deemed to have asbestos. Additionally, by submitting samples and receiving results that are in the care of the Company, Company is better informed about pertinent project information to help property owners move forward. It does not replace a certified asbestos inspection, nor can it be used as the sole basis for determining regulatory compliance.
2. Not a Certified Asbestos Inspection
By using this service, you acknowledge and agree that Premium Prep is not a certified asbestos inspection. Under Colorado state regulations, a certified asbestos inspection must be performed by a Certified Asbestos Building Inspector employed by a CDPHE-licensed asbestos consulting firm. Such inspections are required to determine the presence or absence of asbestos in suspect materials for regulatory purposes.
3. Assumption of Asbestos in Colorado
In Colorado, all suspect building materials (i.e., any material that may contain asbestos) must be assumed to contain asbestos until confirmed otherwise by an official asbestos inspection report prepared by a certified inspector. Lab results indicating "None Detected" do not exempt a material from regulatory assumption requirements unless those results are included in a report issued by a certified inspector.
4. Limitations of Laboratory Results
Laboratory results obtained through Premium Prep, while provided by an accredited laboratory, are not accompanied by a certified inspection report and therefore do not establish regulatory compliance. Results indicating that no asbestos was detected do not constitute formal clearance or proof that the sampled materials are in fact asbestos-free for purposes of renovation, demolition, permitting, or compliance with city, county, state, or federal regulations. Material results provide through Premium Prep are still presumed to contain asbestos by law.
5. Regulatory Consequences
Relying on uncertified sample results may lead to enforcement actions including, but not limited to, Stop Work Orders, penalties, or project delays issued by local building departments, the Colorado Department of Public Health and Environment (CDPHE), or the U.S. Environmental Protection Agency (EPA). The Company shall not be held liable for any such actions resulting from the unauthorized or improper use of Premium Prep results.
6. Advisement and Use of Results
The purpose of the information obtained through Premium Prep is to assist the Company in advising you about potential next steps, including the likely need for a certified asbestos inspection. While the results may offer useful preliminary insights and help reduce the scope and cost of full inspection services, they are not conclusive and should not be relied upon for making final determinations or decisions involving disturbance of building materials.
7. Property Owner Responsibilities
This service is only available to residential property owners, who currently reside in the property where samples will be collected as their primary residence ("Owner"). Samples must be collected by the Owner, who is solely responsible for:
The Company makes no warranty, express or implied, regarding the accuracy or regulatory sufficiency of the results obtained through Premium Prep. The Company does not guarantee that use of this service will exempt you from inspection requirements or regulatory obligations.
9. Limitation of Liability
To the fullest extent permitted by law, the Company disclaims all liability for any damages, penalties, fines, or losses incurred as a result of the use or misuse of information obtained through Premium Prep, including any reliance on laboratory results in lieu of a certified inspection. Use of this service is at your own risk.
10. Acknowledgement
By submitting material samples through Premium Prep, you acknowledge that you have read, understood, and agreed to these Terms and Conditions, that you are the Owner and that you accept all associated limitations and risks.
11. Right of Refusal
Company retains the right to refuse the use of this service to anyone for any reason and samples can only be submitted with the express, written approval of Company.

- Collecting samples in a safe and lawful manner;
- Understanding that there is an inherent risks involved in disturbing suspect asbestos materials, including by sampling them;
- Complying with all applicable federal, state, and local laws and regulations;
- Obtaining a certified asbestos inspection before any renovation, demolition, or other work that may disturb suspect materials.
The Company makes no warranty, express or implied, regarding the accuracy or regulatory sufficiency of the results obtained through Premium Prep. The Company does not guarantee that use of this service will exempt you from inspection requirements or regulatory obligations.
